Criminal procedure law restricts the freedom of a person under suspicion of a crime through protective measures such as arrest, seizure, search, telephone and media tapping, and arrest. The suspect himself or his lawyer has the right to object to these investigation procedures. As a result of the investigation, if the prosecution (prosecutor’s office) comes to the conclusion that the suspect has committed a crime, they prepare an indictment against the suspect and file a criminal case. The duties of judicial criminal courts authorized to hear criminal cases in Turkey are determined according to the nature of the crime and the amount of the penalty. Criminal courts basically consist of two types of courts: criminal court of first instance and high criminal court. The defendant has the right to benefit from the legal assistance of a lawyer at all stages of the trial in court. As a result of the trial, the criminal court may decide on a “judicial fine”, “imprisonment sentence” or “security measure” as a sentence of conviction for the defendant. In the decision, individualization institutions such as postponement of the prison sentence or postponement of the announcement of the verdict (hagb) may be applied, and the prison sentence given to the defendant may also be converted into a judicial fine. After the stages such as criminal case, appeal, appeal and correction of the decision are passed, the execution law process regarding the finalized prison sentence begins. As a rule, the execution of a final prison sentence is carried out in an open or closed prison. The convict whose sentence has been served can be released from prison by taking advantage of conditional release (conditional release) and supervised release measures when he meets certain conditions depending on the nature of his crime.
All these processes in criminal law can be defined in general terms as the process of investigation, prosecution and execution law. The lawyer who defends the person on trial, the victim, the complainant (complainant) or the intervener (participant) in this process, which starts with the investigation phase and ends with the execution of the sentence, is colloquially called a criminal lawyer or heavy criminal lawyer.
